1. Acceptance of Terms

By accessing or using VibeNaming (the "Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree, do not use the Service.

2. Description of Service

VibeNaming provides AI-powered naming and analysis tools across multiple domains, including character naming (NameMyOC), baby naming (NameMyBaby), business naming (NameMyBusiness), pet naming (NameMyPet), plant naming (NameMyPlant), house naming (NameMyHouse), horse naming (NameMyHorse), vessel naming (NameMyVessel), artist naming (NameArtist), gamer naming (NameGamer), name scoring (ScoreMyName), signature generation (NameSignature), English name personalization (NameMe), and surname origin tracing (SurnameOrigin). Some services accept image uploads and use artificial intelligence to analyze the image and generate name suggestions based on the subject's visual characteristics. The Service uses artificial intelligence to generate name suggestions based on user-provided text or image input.

Independent Platform: VibeNaming is an independent product and is not affiliated with, endorsed by, or sponsored by DeepSeek, Alibaba Cloud (Qwen), or any other third-party AI model provider. We provide access to third-party AI models through our custom interface for naming purposes. The Service currently uses the following AI models: DeepSeek (deepseek-v4-flash) for text-based naming and Qwen (Qwen3.5-27B) for image analysis. These models may be updated or replaced at any time. All generated output is plain text name suggestions and does not include image or video generation.

3. User Accounts

You must register for an account to use paid features. You are responsible for maintaining the confidentiality of your credentials and for all activities under your account. You must be at least 13 years of age to use the Service.

4. Virtual Currency (VibeCoin)

VibeCoin is a virtual credit used to access paid features within the Service.
VibeCoin has no monetary value and is not redeemable for cash.
Unused VibeCoin balances may be refunded within the plan's validity period by contacting [email protected]. Refunds are processed through Creem. Partially used VibeCoin balances are non-refundable.
We reserve the right to modify VibeCoin pricing, bonus amounts, or usage rates at any time with reasonable notice.
Unused VibeCoin balances may be forfeited if your account is terminated for violation of these Terms.

5. AI-Generated Content

Name suggestions are generated by artificial intelligence and are provided "as-is" without guarantee of accuracy, originality, or legal availability.
You are solely responsible for verifying that any name you choose does not infringe on existing trademarks or intellectual property rights.
We make no warranty that AI-generated names are unique, available for registration, or free from third-party claims.
For image-based services, uploaded images are processed by third-party AI models solely for the purpose of analyzing visual characteristics and generating name suggestions. We do not use uploaded images for any other purpose.

6. Intellectual Property

The Service, including its code, design, and proprietary algorithms, is owned by VibeNaming and protected by applicable laws. You retain ownership of the names generated for your use, but grant us a non-exclusive license to store and process your content to provide the Service.

7. Acceptable Use

You agree not to:

Use the Service for any illegal purpose or in violation of any applicable laws
Attempt to circumvent VibeCoin payment or usage tracking
Reverse engineer, decompile, or extract the source code of the Service
Use automated scripts or bots to access the Service

Prohibited Inputs and Generated Content: You agree not to upload, submit, or generate:

Names or descriptions that are hateful, discriminatory, harassing, or violent
Content depicting or promoting illegal activities, weapons, or violence
NSFW (Not Safe For Work), sexually explicit, obscene, pornographic, or sexually suggestive material
Content that infringes on any trademark, copyright, or other intellectual property right
Personal identifiable information of others without their consent
Content intended to deceive, impersonate, or commit fraud (including domain squatting, trademark cybersquatting, or phishing)
Instructions or prompts designed to bypass AI safety filters
Images depicting identifiable individuals without their consent
Images containing nudity, graphic violence, or other sensitive content

We reserve the right to review, flag, or remove any content that violates these rules, and to suspend or terminate accounts found in violation. AI-generated name suggestions are provided as creative inspiration only and do not guarantee legal availability for trademark or business registration.

8. Limitation of Liability

To the maximum extent permitted by law, VibeNaming shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Service. Our total liability for any claim shall not exceed the total amount you have paid to us in the twelve (12) months preceding the claim.

9. Disclaimer of Warranties

The Service is provided "AS IS" and "AS AVAILABLE" without warranties of any kind, either express or implied, including but not limited to merchantability, fitness for a particular purpose, or non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or that AI-generated names will meet your expectations.

10. Indemnification

You agree to indemnify and hold harmless VibeNaming, its affiliates, and employees from any claims, damages, or expenses arising from your use of the Service, your violation of these Terms, or your violation of any third-party rights.

11. Termination

We reserve the right to suspend or terminate your account at any time, without notice, for conduct that we believe violates these Terms or is harmful to other users or the Service. Upon termination, your right to use the Service ceases immediately, and any VibeCoin balance may be forfeited.

12. Modifications to Terms

We may update these Terms from time to time. Continued use of the Service after changes constitutes acceptance of the new Terms. We will make reasonable efforts to notify you of material changes.
